These are the terms and conditions applying to our agreement to collect your car from you at Stansted Airport and to return it to you there and to store it for you in the meantime ('our vehicle valet service').
When you book our service by any means or pay for it you are deemed to have accepted these terms and conditions so it is important that you read them carefully because they are binding on you in law. These conditions cannot be changed or altered in any way without our written permission. The latest terms and condition are available and subject to an administration fee.
1. Our obligations to you
We will:
- provide you with full information and reference number for your booking and instructions for drop-off and collection by email or text message or this website.
- keep your personal data safe and only use it as described in our Privacy Policy.
- meet you at the prescribed location at the airport within fifteen minutes of the time indicated by you and shown on your booking form, confirmation email or text.
- monitor the arrival of the return flight notified to us by you and return your car to the agreed location at the airport within thirty minutes of your telephoned confirmation to us that you have completed border and customs formalities and reclaimed all of your luggage.
- meet the first minimum period of short stay parking where applicable. Any additional fees incurred however caused are your responsibility.
2. Limits to our liability
- We will only be liable to pay compensation for any breach of our liabilities for any proven act of neglect by our employees.
- We will not be responsible for any delays caused as a result of circumstances beyond our control such as traffic congestion, delayed flights, security alerts, weather conditions, terrorism, natural disasters, catastrophe or criminal activity.
- We will not be liable in any circumstances for your failure in any event to check in at the airport in time for you to take a particular flight or any additional consequential costs.
- Vehicles and contents are left at the owners risk whilst the vehicle is parked.
- Claims for damages will only be considered if reported to our staff immediately at the airport. Written confirmation must be obtained to confirm damage. All subsequent correspondence to be in writing – email acceptable.
- We accept no liability for mechanical, structural and electrical failure of any part of your vehicle. This includes windscreens, all glass, mirrors, tyres and wheels how so ever caused .We will not be held responsible for any deterioration in the condition of the vehicle whilst in our keeping.
- We accept no liability for any faulty cars, alarm fobs, house or any other keys or valuables which are left on the key ring or inside the vehicle.
- In the event that the car acquires a puncture including slow puncture we reserve the right to either inflate the tyre or change to the spare wheel.
- In the event that the vehicle does not start we reserve the right to jump start your vehicle. However, we will not be held responsible for any consequential damage as a result of this action.
- In the event that we have to pick you up from the terminal building we reserve the right to collect the driver only without luggage and we reserve the right to charge any associated costs we may incur.
- We require customers to have a spare key to the vehicle.
3. Exclusions and limits of our responsibility
- We will not accept any legal responsibility for any indirect loss, such as loss of earning, hotel accommodation or car hire however so incurred.
- We will not accept liability for any loss or damage covered by your own insurance.
- Claims cannot be considered if reported after the vehicle has been returned to your possession.
- We will not pay out more than £25,000 in any one claim. Including damage and total loss to a vehicle.
- We will not be responsible for any minor scratches, dents or damage to your vehicle regardless of your documentation which may not be possible to identify in confined times and weather conditions.
- We should not be held liable for any damages caused by Acts of God or Nature.
- In the event that we agree to any form of repair or compensation (whether liability is admitted or not) you, the customer, will be responsible for an excess payment of £100.00 for any claim up to £500.00. Claims over £500.00 are subject to an excess payment of £500.00
- We will not be held responsible for any claims of any nature however caused below £250.00
- In the event that your vehicle needs to be repaired it must be carried out by our approved repairer.
4. Your obligations to us
In return for our agreeing to provide you with the vehicle valet service you will:
- make full payment in advance using one of our publicised booking methods.
- before departure provide to us full and accurate information relating to your travel plans including return dates, times and flight numbers and your mobile phone number.
- inform us in good time of any changes to any information relating to your travel plans either outbound or inbound.
- call the number given on your confirmation email or text as you approach the airport (but not make illegal use of any telephone equipment to do so).
- arrive no earlier than fifteen minutes before nor fifteen minutes later than the agreed drop-off time.
- call us on your return to the airport as you complete border and customs formalities as set out in the instructions on your booking form, confirmation email or text.
- return to your vehicle within fifteen minutes of making that call and reclaim your vehicle by presenting your copy of the documentation provided to you before departure and providing such photographic identity documentation as we reasonably require.
5. You warrant to us and it is a condition of our accepting your vehicle that:
- your vehicle complies with all statutory and regulatory requirements regarding the use of motor vehicles.
- your vehicle is roadworthy, fully insured, properly taxed and complies with the Road Traffic Act 1988. Your car must be free from any lien or warrant from any third party in any way liable to repossession or seizure.
- you are either the owner or keeper of the vehicle failing which you are authorised by the owner or keeper of the vehicle to use our vehicle valet service.
- there are no illegal, dangerous or stolen items or matter in the vehicle.
6. Changes Cancellations Delays and Incurred Costs
- Amendments and cancellations are subject to the terms and conditions of the product. Non-flexible products may not be amended nor transferred and are not eligible for a refund under any circumstances.
- Flexible products which are cancelled within 7 days of check-in date will not receive a refund. Cancelled bookings notified before 7 days will be given a 50% credit to be used within 1 year.
- Amendments to travel are subject to a £20.00 minimum amendment fee.
- If you do not appear at all or if we do not receive notification of cancellation before the drop-off time you will be liable to pay the full amount of our charges as billed to you.
- If you fail to collect your car at the appointed time you will pay us the rate of £10.00 per day for the first two days and £5.00 per day thereafter.
- We may assign your booking to another operator of equal service quality under the same terms.
- We are at liberty to keep and to refuse to return your vehicle while any sums in respect of it are due to us and remain unpaid.
- Any costs incurred by the company on the customers behalf will be the responsibility of the customer.
7. Acceptable Vehicles
Please note there are booking restrictions on this service which is intended for privately owned vehicles ONLY. Additionally, if your vehicle meets one or more of the following criteria it may be refused at the roadside;
- Commercial vehicles of any kind.
- Any vehicle that can be described as a van
- Anything with a flat bed.
- With the exception of roof boxes and roof racks any vehicle with extraneous fittings. E.G., Ladders, tool boxes etc.
- Vehicles capable of carrying more than seven people.
Please note that any vehicle refused for any of the above reasons is NOT eligible for any form of refund or recompense - it is your responsibility to ensure your vehicle meets our acceptance criteria.
8. Invalidity
Each clause or any part at all of this agreement is to be regarded as independent of the others. This means that should any clause or any part at of this agreement be found to be unenforceable or invalid it will not affect the enforceability or validity of the rest of this agreement.
9. Jurisdiction
These Terms and Conditions shall be interpreted, constructed and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.
